1. Acceptance of Terms

By accessing and using QuickCards ("the Service"), operated by QuickCards ("we," "us," or "our"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service. These terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

QuickCards provides an AI-powered flashcard generation and study platform. Our services include:

AI-generated flashcards from text, PDFs, images (including handwritten notes), URLs, YouTube videos, and topic prompts
Manual flashcard creation, cloze deletions, and image-occlusion cards
Auto-generated AI mnemonics and per-card AI Tutor explanations
Deck organization with folders, subjects, and tags
Study modes including swipe study, quizzes, cram mode, spaced repetition (SM-2/FSRS-style scheduling), and review queues
Flashcard games (e.g., Match Matrix, Recall Rush, Gravity Drop, Survival, Boss Battle, Exam Simulator)
Progress tracking, study streaks, streak freezes, heat maps, achievements, and per-card statistics
Community features for sharing, discovering, liking, rating, and saving public decks
AI-powered deck summaries and deck chat
Deck imports (CSV, Quizlet, Anki .apkg) and exports (CSV, PDF, Anki .apkg)
Email and web-push study reminders
Teacher Mode: classes, join codes, assignments, and student progress tracking
A referral program with rewards for inviting other users
Free, signed-out tools for one-off flashcard generation, rate-limited per device

3. User Accounts

To use certain features of our Service, you must create an account. When you create an account, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Maintain the security and confidentiality of your login credentials
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these terms or are inactive for extended periods.

4. User Content

You retain all ownership rights to the content you create using our Service, including flashcards, decks, notes, and any other materials ("User Content"). By using our Service, you grant us a non-exclusive, worldwide, royalty-free license to:

Store, process, and display your content to provide the Service
Create backups and perform maintenance operations
Share your public content with other users (for public decks only)

You are solely responsible for your User Content and represent that you have all rights necessary to grant us this license.

5. Acceptable Use Policy

You agree not to use the Service to:

Create content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Infringe upon intellectual property rights of others
Upload malicious code, viruses, or harmful software
Attempt to gain unauthorized access to our systems or other users' accounts
Use automated systems to access the Service without permission
Interfere with or disrupt the Service or servers
Engage in commercial activities without our prior written consent
Collect or harvest user data without consent

We reserve the right to remove any content and terminate accounts that violate these guidelines.

6. Subscription Plans and Payments

QuickCards offers both free and paid subscription plans:

Free Plan: Limited monthly AI generations with core features (resets on the 1st of each month). AI-generated decks are capped at 50 cards per deck. Manual deck creation is unlimited.
Basic Plan: Higher monthly AI generation limits, file uploads, and additional features. AI-generated decks are capped at 50 cards per deck.
Pro Plan: Unlimited AI generations, no per-deck card cap on AI generation, advanced study modes, and premium features.
Pro Max Plan: Everything in Pro plus our highest priority AI models, expanded file processing, and the most generous limits across every feature — built to be the best plan for serious students.
Lifetime Plans (Pro Lifetime & Pro Max Lifetime): One-time payment for permanent access to the corresponding tier, with no recurring billing.
Teacher Plan: A separate subscription for educators ($9.99/month or $69.99/year, with a 7-day free trial). Includes Pro Max-level access plus class management, assignments, and join codes.

Manual flashcard creation is unlimited on every plan, including the Free plan. Card caps and AI generation limits apply only to AI-assisted creation. Certain features — including AI Tutor, advanced games, image occlusion, image generation, and unlimited spaced-repetition decks — are gated to specific tiers as described on our Pricing page, and limits may change as we evolve the Service.

Subscription fees are billed in advance on a monthly or annual basis. All payments are processed securely through our payment provider. Subscriptions auto-renew unless cancelled before the renewal date.

6a. Teacher Mode

Educators using Teacher Mode are responsible for obtaining any consents required by their school, district, or applicable law (including FERPA and COPPA in the United States) before inviting students, sharing assignments, or otherwise processing student information through the Service. Class join codes should be shared only with intended class members. We process student data on behalf of the educator/school for the purpose of operating the class.

6b. Referral Program

Our referral program lets you earn rewards by inviting new users. You may not use spam, paid ads bidding on our brand, misleading claims, self-referrals, or fake accounts to generate referrals. We may withhold, reverse, or revoke rewards and disable the program for any account that abuses it.

6c. Free Tools and Anonymous Use

Some tools can be used without an account. These tools are rate-limited per device and intended for personal, non-commercial evaluation. We may modify, throttle, or remove free tools at any time and may block devices that abuse them.

7. Refund Policy

Subscription fees are generally non-refundable except as required by law. If you believe you are entitled to a refund due to a billing error or service issue, please contact us within 7 days of the charge. We review refund requests on a case-by-case basis.

8. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by QuickCards and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. Our trademarks may not be used without our prior written permission.

9. AI-Generated Content Disclaimer

Our AI features — including flashcard generation, deck summaries, deck chat, AI Tutor explanations, automatic mnemonics, image occlusion suggestions, image generation, and short-answer grading — are designed to assist with learning but may occasionally produce inaccurate, incomplete, or biased content. You should always verify important information from authoritative sources and should not rely on the Service for medical, legal, financial, or other professional advice. We do not guarantee the accuracy of AI-generated content or grading outcomes.

10. Limitation of Liability

To the maximum extent permitted by law, QuickCards shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

12. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately. You may also terminate your account at any time through your account settings.

13. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any material changes by email and/or by posting a prominent notice on our Service prior to the change becoming effective. Your continued use of the Service after changes constitutes acceptance of the new terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
